Terms of Service
These Terms of Service ("Terms") govern your use of the Alette web application (myalette.app), mobile application, and related services (collectively, the "Service"), operated by Amy Tourte LLC, doing business as Alette ("we," "us," or "our"). Our marketing website at alettemediation.com is also operated by Amy Tourte LLC. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About the Service
Alette is a mediation preparation tool. It helps individuals organize information, gather documents, and prepare for divorce mediation sessions. Alette is designed to support your preparation process — it does not provide mediation services, legal advice, financial advice, tax advice, or therapeutic counseling.
Important: Nothing in the Service constitutes legal, financial, or professional advice. The information and tools provided are for organizational and educational purposes only. You should consult qualified professionals for advice specific to your situation.
2. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@amytourte.com if you believe your account has been compromised.
We authenticate users via email-based one-time passwords (OTP). A one-time code is sent to your email each time you sign in. We do not store passwords. Each device maintains its own authentication session for your privacy and security.
4. Acceptable Use
You agree to use the Service only for its intended purpose: preparing for mediation. You agree not to use the Service to harass, threaten, or harm any person; upload content that is illegal, defamatory, or infringes on third-party rights; attempt to gain unauthorized access to the Service or its infrastructure; reverse-engineer, decompile, or disassemble any part of the Service; or use the Service for any commercial purpose other than your personal mediation preparation.
5. Your Content
You retain ownership of all content you create or upload through the Service, including preparation notes, financial information, and documents ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely to provide the Service to you.
You are responsible for the accuracy of Your Content. We do not verify or validate the information you enter.
6. Subscription and Payment
Access to the Service requires a paid subscription. Subscription pricing, billing frequency, and payment terms are presented at the time of purchase and may be updated with advance notice. Payments are processed through our third-party payment processor. When subscribing via the mobile application, billing may be handled through the Apple App Store or Google Play Store and subject to their respective payment terms and refund policies.
You may cancel your subscription at any time. For web subscriptions, cancellation is available through your account settings. For mobile subscriptions, cancellation is through your device's app store settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods.
7. Intellectual Property
The Service, including its design, features, content, and underlying technology, is owned by Amy Tourte LLC and is protected by applicable intellectual property laws. "Alette" is a trade name of Amy Tourte LLC. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee that the Service will meet your specific needs or produce any particular outcome in your mediation process.
Alette is not a law firm, mediation service, or financial advisory service. Use of the Service does not create an attorney-client, mediator-client, or fiduciary relationship of any kind.
9. Limitation of Liability
To the maximum extent permitted by law, Amy Tourte LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of or inability to use the Service.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Amy Tourte LLC, its officers, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us at hello@amytourte.com. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Texas. You agree to waive any right to a jury trial or to participate in a class action.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the app and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amy Tourte LLC regarding your use of the Service.
